These Terms and Conditions (“T&Cs”) govern your access to and use of the Sakura website and social media channels, and all purchases of our indoor plants, curated gifts, and accessories (“Products”). By browsing, registering, or placing an order, you agree to these T&Cs and to our Return & Refund Policy, Privacy Policy, and Shipping Policy, which are incorporated by reference. Please read them carefully.

Definitions

• “Buyer”, “you” or “user” means the person who buys or browses Products on this website.

• “Sakura”, “we”, “us” or “our” means the proprietorship that owns and operates this website.

• “Products” means the plants, gifts, and accessories offered for sale on the website.

• “List Price” means the price listed on the website for a Product, as revised from time to time.

General

Use of this website and its services is governed by these T&Cs. By transacting on this website, you are contracting with Sakura and agree to the policies applicable to it. We reserve the right to modify, add to, or remove any part of these T&Cs at any time without prior notice. We request you to review this page periodically. Your continued use of the website after changes are posted constitutes acceptance of those changes.

Eligibility

This website is available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. If you are a minor under 18 years of age, you may use the website only under the supervision of a parent or legal guardian. We may refuse access or cancel an order if we find that you are ineligible to transact under applicable law.

Product Descriptions

We make every effort to ensure accuracy in product descriptions, images, pricing, and availability. As plants are natural, living products, slight variation in size, shape, and colour from the images shown is normal and expected. We do not warrant that descriptions or other content are complete, current, or error-free.

Orders, Acceptance & Cancellation

Placing an order does not by itself constitute a confirmed order. All orders are treated as offers to purchase and are subject to acceptance by Sakura. We reserve the right to refuse or cancel any order, without giving a reason, for reasons including but not limited to product availability, errors in price or description, or suspected fraud. Placing an order shall be treated as evidence of acceptance of these T&Cs.

As our products are living and often prepared specifically for each order, cancellations or modifications are generally not possible once an order is placed. If you need urgent assistance, please contact us immediately and we will try our best to help before dispatch, although changes cannot be guaranteed.

Pricing & Payment

All prices are displayed in Indian Rupees (INR) and are inclusive of applicable GST. Shipping and any additional fees are shown at checkout. We accept prepaid orders only (no Cash on Delivery) through secure, approved payment gateways. We reserve the right to correct any pricing or description errors and to cancel and refund any order placed against such an error.

Intellectual Property

All text, graphics, designs, photographs, logos, trademarks, and other materials on this website are owned or licensed by Sakura and protected by copyright, trademark, and other laws. No content may be copied, reproduced, posted, transmitted, or distributed in any form without our prior written consent.

User Conduct & Content

You agree not to misuse the website, including by introducing viruses or malicious code, attempting unauthorised access to our servers or systems, or interfering with the website's operation. Where the website allows you to post content such as product reviews, you are solely responsible for what you post, and you must not post content that:

• infringes the intellectual property, privacy, or other rights of any person;

• is unlawful, defamatory, harassing, obscene, hateful, or objectionable, or that constitutes an indecent representation of women under the Indecent Representation of Women (Prohibition) Act, 1986;

• is spam, chain mail, or unsolicited commercial material; or

• contains software viruses or any code designed to disrupt the website.

We do not routinely monitor user content but reserve the right to review, remove, or report it, and to cooperate with law-enforcement authorities where required. By posting a review or other content, you grant Sakura a non-exclusive, royalty-free licence to use, display, and reproduce it in connection with the website.

Limitation of Liability

To the extent permitted by law, Sakura shall not be liable for any indirect, incidental, or consequential loss, including loss of profit, arising from the use of, or inability to use, the website or Products. Nothing in these T&Cs limits any liability that cannot be excluded under the Consumer Protection Act, 2019 or other applicable law. Where liability cannot be excluded, it is limited to the value of the Product purchased.

Indemnity

You agree to indemnify and hold harmless Sakura and its officers, employees, and partners against any loss, damage, cost, or liability arising from your breach of these T&Cs, your misuse of the website, or your violation of any law or third-party right.

Force Majeure

Neither party shall be liable for any delay or failure to perform caused by events beyond its reasonable control, including strikes, lockouts, accidents, acts of God, breakdowns, shortage or unavailability of raw materials from natural sources, and war. In such cases, the affected party shall be entitled to a reasonable extension of time for delivery.

Third-Party Links

The website may contain links to third-party websites. We are not responsible for the content, products, or privacy practices of those websites and do not endorse them.

Severability

If any provision of these T&Cs is held invalid or unenforceable by a court of competent jurisdiction, that provision shall be severed and the remaining provisions shall continue in full force and effect.

Governing Law & Jurisdiction

These T&Cs are governed by the laws of India. The courts of Surat, Gujarat shall have exclusive jurisdiction over any dispute arising from or relating to these T&Cs or your use of the website.
